It is the policy of the Commonwealth of Virginia to encourage the utilization of its water resources to the greatest practicable extent, to control the waters of the Commonwealth, and also to construct or reconstruct dams in any rivers or streams within the Commonwealth for the generation of hydroelectric energy for use or sale in public service. The State Corporation Commission is responsible for regulating the development of waters of the Commonwealth. A license from the Commission is required prior to the construction or reconstruction of any dam in the Commonwealth that will be used for the generation of hydroelectric energy. This legislation contains additional information on the siting, permitting, and licensing of hydroelectric dams.
