Summary

The South Carolina Mining Act seeks to offer the greatest practical degree of protection and restoration to usefulness, productivity, and scenic values of all SC lands and waters involved in mining. The Act establishes that no mining may be carried on in the State unless plans for the mining include reasonable provisions for protection of the surrounding environment and for reclamation of the affected land area. The Act authorizes the Department of Health and Environmental Control to enact and implement regulations pertaining to mining operations. All exploration activities must have a certificate of exploration issued by the Department, and permits from the Department are likewise required prior to the beginning of any mining operation.
