Summary

The Department of Health and Environmental Control is authorized to promulgate rules and regulations to prevent exposure of persons, animals, or the environment to hazardous waste. The construction, alteration, and operation of a hazardous waste treatment, storage, or disposal facility, as well as the transportation of hazardous waste, requires a permit from the Department. This legislation contains further provisions relevant to the permitting and operation of such facilities, and authorizes the Department to levy fees on generators of hazardous waste. The Act also establishes the Hazardous Waste Management Research Fund, which is used to finance research on projects and new or emerging technologies that may have a direct and positive impact on waste minimization and reduction in South Carolina.
