Hawaii Hawaii EA Process (9-HI-b)

The developer begins the Draft Environmental Assessment Process if the Approving Agency determines that the project triggers the Hawai`i Environmental Policy Act (HEPA), Chapter 343, Hawaii Revised Statutes. The EA must contain all of the information listed in Hawaii Administrative Rules (H.A.R.) § 11-200-10.

9-HI-b.1 – Draft Environmental Assessment

The Developer prepares a Draft Environmental Assessment for the project. (Note that "developers" may also be government agencies.) The Draft Environmental Assessment includes:

  • Identification of the applicant, approving agency, and the various parties consulted in making the assessment;
  • a description of the affected environment;
  • impacts to cultural practices and resources; and
  • other information listed in H.A.R. 11-200-10 to 11-200-13.

9-HI-b.2 – Review Draft Environmental Assessment

The approving agency reviews the Draft Environmental Assessment.

9-HI-b.3 – Does the Agency Approve Draft EA

The approving agency determines whether to approve the Draft EA.

9-HI-b.4 – Draft Environmental Assessment (EA) with OEQC Publication Form to OEQC

The agency submits the Draft EA, which has been prepared by the developer, to the Office of Environmental Quality Control (OEQC) with the Office of Environmental Quality Control Publication Form.

9-HI-b.5 – Public Notice of Draft EA for Public Comment and Allow for Comment

The OEQC publishes notice of the Draft EA in The Environmental Notice and allows for comment on the Draft EA for a period of 30 days from the date of publication.

9-HI-b.6 – Comment on Draft EA

Members of the public comment on the Draft EA.

9-HI-b.7 – Review Comments on Draft Environmental Assessment

The agency and the developer review comments on the Draft Environmental Assessment.

9-HI-b.8 – Does the Approving Agency Find the Activity Has a Significant Impact and Decide to Initiate the EIS Process

The approving agency determines whether the activity has a significant impact under Hawaii Administrative Rule 11-200-12 based on any additional information received during the public notice and comment period. If the agency finds a significant impact based on the new information, the agency has the option to require the developer to prepare an Environmental Impact Statement at this point.

9-HI-b.9 – Revise Draft Environmental Assessment (EA)

The developer revises the Draft Environmental Assessment to address any concerns raised through comments on the Draft Environmental Assessment.

9-HI-b.10 – Final Environmental Assessment

The developer prepares a Final Environmental Assessment for the project and delivers to the Approving Agency.

9-HI-b.11 – Does the Agency Approve Final EA

The approving agency determines whether to accept the Final EA.

9-HI-b.12 to 9-HI-b.13 – Does the Approving Agency Find the Activity Has a Significant Impact

The approving agency determines whether the project will have a significant impact on the environment. If the accepting agency determines the project will have a significant impact on the environment, the developer must prepare an Environmental Impact Statement.

9-HI-b.14 – Finding of No Significant Impact (FONSI)

If the agency determines the project will not have a significant impact on the environment, the agency issues a Finding of No Significant Impact (FONSI), including the reasons for the agency’s determination. If the agency issues a FONSI, the developer is not required to complete the Environmental Impact Statement (EIS) process.

9-HI-b.15 to 9-HI-b.17 – Does Anyone Challenge the Agency’s Determination by Filing Suit Within 30 days of the FONSI

Any party may challenge the accepting agency’s FONSI by filing suit within 30 days of the decision to issue a FONSI. If a party files suit, the FONSI is reviewed through the judicial appeals process.
