Alaska Geophysical Exploration Permit (4-AK-b)

A Geophysical Exploration Permit is necessary for conducting seismic surveys on state lands and waters. These studies help to identify geological structures with potential accumulations of oil or gas. These permits are a type of land use permit and are sometimes called Seismic Permits. The Alaska Division of Oil and Gas issues geophysical exploration permits according to the following procedure.


Geophysical Exploration Permit Process

4-AK-b.1 - Application for Geophysical Exploration Permit

A Geophysical Exploration Permit is necessary for conducting seismic surveys on state lands and waters. These studies help to identify geological structures with potential accumulations of oil or gas. These permits are a type of land use permit and are sometimes called Seismic Permits. The Geophysical Data Submission Requirements lay out the appropriate requirements when submitting a permit application for any type of geophysical exploration.

4-AK-b.2 to 4-AK-b.3 - Review Application Materials for Completeness

Because the geophysical exploration permit is a specific type of land use permit, it follows the same procedure as obtaining any other type of land use permit from DO&G. DO&G will review the permit application and determine if the proposed exploration activities meet the established criteria for conducting seismic surveys in Alaska.

4-AK-b.4 - Notify Adjacent, Upland Property Owner if Project is in Shoreland, Tideland, or Submerged Land

According to 11 AAC 96.030(c), ADNR is require to give notice to an upland owner of an application involving the use of shoreland, tideland, or submerged land adjacent to the upland owner's property. The upland owner is also given priority in obtaining a land use permit on these types of land.

4-AK-b.5 - Public Notice (Optional)

If ADNR determines it is necessary, public notice may be required before issuing a land use permit (11 AAC 96.030). If public notice is required, the applicant must pay any advertising costs for a published public notice.

4-AK-b.6 - Does Proposed Use Comply with 11 AAC 96.040(b)

ADNR will issue permits in compliance with chapter 96 and in accordance with 11 AAC 96.040(b): "to assure compliance with this chapter, to minimize conflicts with other uses, to minimize environmental impacts, or otherwise to be in the interests of the state."

4-AK-b.7 - Bond, Certificate of Insurance (As Required)

Unless ADNR waives the requirement after considering the applicant's history of compliance and the potential risk to the state, the applicant must furnish security acceptable to the department in the form of a bond or certificate of insurance. Applicants of a Geophysical Exploration Permit usually have a Statewide Miscellaneous Land Use Bond of $100,000.

4-AK-b.8 to 4-AK-b.9 - Geophysical Exploration Permit

An approved geophysical exploration permit will be specific to each individual permit and the developer should consult DO&G for more information regarding typical requirements of individual permits.

In accordance with 11 AAC 96.210(1) the developer must notify DO&G of all seismic exploration data and submit a written notice of all exploration data obtained under the permit within 30 days after termination of seismic exploration.

4-AK-b.11 - Report Geophysical Data Results to DO&G

The bonding required by DO&G is to satisfy the geophysical data submittal requirements after all seismic activity has been completed by the developer.
