New Mexico State Highway Encroachment Permits (3-NM-c)

The New Mexico Department of Transportation (NMDOT) District Offices protect the State’s right of ways (ROWs) and facilitate and coordinate the safe and efficient operation of New Mexico’s highways. If a project will encroach on existing state ROWs, the District Engineers from six districts have authority to approve permits for the construction of utility facilities within a state ROW as well as construction, relocation or modification of an access point to state ROWs.

3-NM-c.1 to 3-NM-c.2 – Does the Proposed Activity Require Utility Lines within the NMDOT ROW?

If the proposes project or activity requires any utility lines to be located within the NMDOT ROW, the developer should consult with the New Mexico Department of Transportation and follow procedures outlined in Public Highway Utility Accommodation Permit:

3-NM-c.3 to 3-NM-c.5 – Does the Proposed Activity Require a New, Modified or Relocated Access Point on Public ROW?

If the proposed project or activity requires the construction, modification or relocation of any temporary or permanent access points on public ROWs, the developer should consult with the New Mexico Department of Transportation and follow procedures outlined in Permit to Construct Access Opening on Public ROW :

If neither of the above permits is required for the project, the developer may proceed with the project.
