Hawaii Permit to Construct Upon a State Highway ROW (3-HI-e)

The developer must obtain a Permit to Perform Work Upon a State Highway from the Hawaii Department of Transportation Highways Division under H.R.S. 264-7 to perform work within a State Highway right-of-way (i.e. utility services connections, overhead/underground utility crossings, etc.).

3-HI-e.1 – Application for Permit to Perform Work Upon State Highways

The developer must complete and submit the Permit to Perform Work Upon State Highways Application to the Hawaii Department of Transportation Highways Division. See Hawaii Clean Energy Initiative Construction Upon a State Highway Permit Packet.

3-HI-e.2 to 3-HI-e.3 – Review Application For Completeness

The Hawaii Department of Transportation Highways Divisionreviews the application for completeness and accepts the application if complete.

3-HI-e.4 – Review Application

Once the Hawaii Department of Transportation Highways Division accepts the application as complete, it reviews the application for permit approval. The DOT considers whether the utility/facility will:

  • Materially alter the visual quality and view of highway roadsides and adjacent areas;
  • Conflict with existing or planned uses of highway rights-of-way for highway purposes;
  • Meet specific utility requirements for freeways listed in H.A.R. 19-105-10; and
  • Meet specific utility requirements for highways other than freeways listed in H.A.R. 19-105-14.

3-HI-e.5 to 3-HI-e.6 – Does DOT Approve the Application?

The Hawaii Department of Transportation Highways Division determines whether to approve the permit application and if approved issues the developer a Permit to Perform Work Upon State Highways.
