Hawaii Use and Occupancy Permit (3-HI-d)

A developer needs a Use and Occupancy Permit from the Hawaii Department of Transportation Highways Division under H.A.R. 19-105 to perform construction adjacent to and within the highway right-of-way, and/or park on a restricted section of highway under state jurisdiction.


Use and Occupancy Permit Process

3-HI-d.1 – Use and Occupancy Permit Application

If the project will perform construction adjacent to and within a highway right-of-way and/or park on a restricted section of highway under state jurisdiction, the developer needs to apply for a Use and Occupancy permit from the Hawaii Department of Transportation Highways Division. H.A.R. 19-105-5. The developer should submit a Use and Occupancy Permit application which includes the location in the highway, the date and time of construction, a certificate of insurance covering the construction the developer will perform under the permit, and the construction plans. 3-HI-d.2 – Review Application

The Hawaii Department of Transportation Highways Division reviews the application. In most cases, requests are reviewed and processed by the District Office within one day. Projects requiring headquarters review may take three weeks. This may be necessary if the suitability of trees or plants are questionable, there is a possibility of conflict with future highway improvements, integration with future landscaping plans is necessary, other work is also involved, or questionable features exist.

3-HI-d.3 to 3-HI-d.4 – Does DOT Approve the Application?

If the Hawaii Department of Transportation Highways Division approves the application the developer receives a Use and Occupancy Permit to perform construction adjacent to and within the highway right-of-way and/or park on a restricted section of highway under state jurisdiction.
