Hawaii RCRA (18-HI-b)

The Resource Conversation and Recovery Act (RCRA) Section 3005 requires the EPA to establish permitting requirements for treating, storing, and disposing of hazardous waste. To own or operate a facility or enterprise that engages in the treatment, storage, or disposal of hazardous waste as defined by Hawaii Administrative Rules § 11-261-3, an operator needs a Hazardous Waste Treatment, Storage, and Disposal Permit from the Hawaii Department of Health Solid and Hazardous Waste Branch (DOH) under 40 CFR 270.


RCRA Process

18-HI-b.1 - Provide Public Notice and Hold Informal Pre-Application Meeting

18-HI-b .2 – General Form for Information (EPA Form 8700-23) and Notification of Regulated Waste Activity (EPA Form 8700-12)

The developer completes and informally submits Part A – General Form for Information (EPA Form 8700-23) and Part B – Notification of Regulated Waste Activity (EPA Form 8700-12) to the DOH. Both new and existing facilities that treat, store, or dispose of regulated hazardous waste are required to submit a RCRA Hazardous Waste Part A Permit Application. Part A of the permit application includes both RCRA subtitle C Site Identification Form and the Hazardous Waste Permit Information form, along with maps, drawings, and photographs. Part B of the permit application contains detailed, site-specific information.

18-HI-b.3 - Publish Notice and Allow for Comment on Informal Application

The DOH publishes notice and allows for comment on the developer’s informal Hazardous Waste Treatment, Storage, and Disposal Permit Application.

18-HI-b.4 - Hold Pre-permitting Meeting

The DOH holds a pre-permitting meeting with the developer to discuss submittals and allow for revising, if necessary.

18-HI-b.5 – General Form for Information (EPA Form 8700-23) and Notification of Regulated Waste Activity (EPA Form 8700-12)

The developer formally submits the completed Part A – General Form for Information and Part B – Notification of Regulated Waste Activity to the DOH.

18-HI-b.6 - Publish Notice and Allow for Comment on Formal Application

The DOH publishes notice and allows for comment on the developer’s formal Hazardous Waste Facility Permit Application.

18-HI-b.7 - Review Application Material

The DOH reviews the application material and comments on the formal application to determine whether to approve or deny the Hazardous Waste Treatment, Storage, and Disposal Permit Application.

18-HI-b.8 – Comment on Application

18-HI-b.9 to 18-HI-b.11 – Is a Hearing Requested

18-HI-b.12 - Hazardous Waste Treatment, Storage, and Disposal Permit

If the DOH approves the developer’s permit application, the DOH issues a Hazardous Waste Treatment, Storage, and Disposal Permit.
