Hawaii Noise Permit (17-HI-a)

A developer may need to obtain a Noise Permit from the Hawaii Department of Health Indoor and Radiological Health Branch to engage in construction, expansion, or demolition of buildings, roadways, and other structures that exceeds the maximum permissible noise levels. The Hawaii DOH regulates noise control under Hawaii Administrative Rules (H.A.R.) 11-46.


Noise Permit Process

17-HI-a.1 to 17-HI-a.2 – Will Construction, Expansion, or Demolition Activities Exceed Maximum Permissible Noise Levels

If the construction, expansion, or demolition activities exceed the maximum permissible noise levels, the developer must obtain the appropriate noise permit for the activity, otherwise the developer may continue with the project.

17-HI-a. 3 - Will the Activity Take Place Outside of Normal Construction Hours

If the activity exceeding the maximum permissible noise levels will take place outside of normal construction hours (7:00 am-6:00pm, Monday-Friday; 9:00am-6:00pm Saturday) then the developer must submit a Community Noise Variance Application.

17-HI-a.4 - Community Noise Variance Application

Developers seeking to exceed maximum noise levels outside of normal construction hours must complete a Community Noise Variance Application and submit to the Hawaii Department of Health Indoor and Radiological Health Branch. The Community Noise Variance Application should include the required information listed in H.A.R. 11-46-8(4).

17-HI-a.5 – Does the Activity Meet Any Criteria that Requires a Community Noise Permit

The construction activity will require a Community Noise Permit if the activity:

(1) Uses a jackhammer, hydraulic ram, pile driver;

(2) Exceeds $250,000 in costs, based on the value of the project list on the C&C of Honolulu building permit;

(3) Exceeds the maximum noise level of 78 decibels when measured at the property line.

17-HI-a.6 – Community Noise Permit Application

If the proposed activity requires a Community Noise Permit, the developer must submit an application with the information listed in H.A.R. 11-46-7(d),including:

  • the developers information;
  • the location of the activity;
  • a description of the activity;
  • the equipment the activity will utilize; and
  • an estimated duration of the construction activity.

17-HI-a.7 – Notification of Intent Application

If the developer is constructing a new facility or expanding, repairing, or otherwise modifying an existing facility the developer must submit a Notification of Intent Application before beginning construction.

17-HI-a.8 to a.9 – Review Application Material for Completeness

The Hawaii Department of Health Indoor and Radiological Health Branch reviews the appropriate application for completeness and accepts the application if complete. If the application is not complete, the DOH will require the developer to submit additional information to ensure the application is complete.

17-HI-a.10 – Review Application Material

The Hawaii Department of Health Indoor and Radiological Health Branch reviews the appropriate application and determines whether to issue a Community Noise Permit or Notification of Intent based on the factors listed in H.A.R. 11-46-7(b).

17-HI-a.11 – Community Noise Permit or Notification of Intent

If the Hawaii Department of Health Indoor and Radiological Health Branch approve the application, the DOH issues a Community Noise Permit or Notification of Intent.
