A developer must consider the project's impact on state cultural and historical resources.

State Cultural Considerations Overview Process

11-MT-a.1 - Have Potential Human Remains Been Discovered?

If the developer discovers human skeletal remains, a burial site, or burial material during construction or other ground-disturbing activity, the developer must proceed under the Montana Human Skeletal Remains and Burial Site Protection Act.

11-MT-a.2 - Human Remains Process

Human Remains Process:

11-MT-a.3 - Have Other Cultural Resources Been Discovered on State Land?

If the developer discovers a "heritage property or paleontological remains" on state property must proceed under the state cultural resource process. (MCA 22-3-421)

Cultural Resource Discovery:

11-MT-a.5 - No Permit Needed; Continue with Project
