Colorado State Cultural Considerations (11-CO-a)

In Colorado, most proposed projects will trigger the State’s historic preservation process directed by the Colorado Office of Archaeology and Historic Preservation. State Cultural Considerations Process

11-CO-a.1 to 11-CO-a.2 – Does the Project Involve a State Action That May Affect a Historic Property?

In Colorado, the State historic preservation process is triggered by projects involving a state action that may affect a nominated or listed State Register property. The Office of Archaeology and Historic Preservation (OAHP) consults with state agencies pursuant the State Register Act to determine how a proposed project might affect eligible or listed historic properties and to consider alternatives to avoid, minimize, and mitigate effects to such properties. 8 CCR 1504-5; History Colorado: Colorado State Register of Historic Properties Webpage; History Colorado: Consultation Guidance. 11-CO-a.3 to 11-CO-a.5 - Have Potential Human Remains Been Discovered?

A hydropower developer who discovers or knowingly disturbs suspected human skeletal remains is required to report their findings. According to Colo. Rev. Stat. sections 24-80-1301 to 1305, "human remains" means any part of the body of a deceased human being in any stage of decomposition. If the developer discovers potential human remains, the developer should initiate the Human Remains Discovery Process. For more information, see:
