North Dakota Bulk Transmission Land Use Planning(1-ND)

In North Dakota, land use planning is delegated to counties and municipalities. N.D.C.C. § 11-33; N.D.C.C. § 40-47. However, a permit from the North Dakota Public Service Commission may preempt certain land use plans. N.D.C.C. § 49-22-16. The bulk transmission developer should contact the appropriate local government to ensure that the proposed transmission project is consistent with planning, zoning, and development regulations.
