RAPID/Best Practices/Memorandums of Understanding (MOUs) +'''PARTICIPATION''' ''Include Appropriate Signatories''. Having the appropriate high-level signatories is important. Governor, or Secretary of the Interior (or similar high-level official) adds weight and encourages commitment from employees. ''Buy-in/leadership from federal agency regional levels is critical''. Buy-in/leadership at the agency regional level is critical to ensure higher-level leadership buy-in, and provide clear direction to project managers and field offices to develop a consistent sense of commitment and responsibility throughout all levels of agency involvement. ''Include Governor’s Energy Office representatives as signatories''. Where they exist, governor’s energy office representatives can be included as signatories to represent statewide interests. '''ELEMENTS OF MOUs''' MOUs often do not incorporate the functional project management provisions required to move the project forward by holding staff accountable to plans and schedules. ''Include roles and responsibilities''. In the body of the MOU, list and define roles and responsibilities for major participants, including project managers, POCs, high-level signatories, and agencies. ''Hold regular meetings''. Commit in MOU to having regular (monthly or quarterly) meetings with attendance from key supervisory personnel from regulatory agencies. ''Include project timelines and schedules''. One of the major challenges with interstate transmission is the time it takes to site and permit a project, which can exceed 7-10 years. Including a project timeline and schedule goals/milestones provides a target for the team to shoot for, that is agreed upon by all signatories. To account for unforeseen circumstances, include a process by which the schedule can change, perhaps by approval of the majority of signatories. ''Include a mechanism for tracking progress''. Use a tracking mechanism, such as an action item list, and write the tracking mechanism into the MOU. The action item list will coincide with the schedule, and can be used to track tasks, issues, and progress. At the regular meetings, a simple report can be developed that tracks the schedule and identifies outstanding action items and issues. ''Include a dispute resolution process''. Dispute resolution processes are not often included as part of MOUs, but should be in order to provide a forum for addressing conflicts. There are different approaches to dispute resolution, and each approach may be more or less appropriate for particular agencies or participants. Some MOUs have included a process of escalation up an agency chain to high-level signatories, who are then responsible for making decisions. Others include an arbitration process. ''Include documentation procedures''. Include and formalize how process will be documented and where documentation would be stored. '''IMPLEMENTATION OF MOUs''' After the MOU is completed, the following best practices are recommended for successful implementation. ''Assign dedicated staff to the project''. Assign names in the MOU (not just titles) and a process by which names may be changed. Also identify officials responsible for high-level oversight and decision making by name, and not just office. ''Use facilitators and mediators''. Identify/hire facilitator or mediator for collaborative group who will assist in development of the MOU. This could be especially helpful in large groups, or in groups where participants have a history of controversy between them. A facilitator/mediator can also be helpful run effective meetings, and create documentation when other participants do not have time. ''Commit Resources''. In SCE’s MOUs with agencies, they commit to funding agency full time employees that would be dedicated to the project. This can occur in a utility-agency MOU as a separate agreement. ''Enable Participation of State Agencies''. If necessary, enable (through legislation or otherwise) state agencies to enter into agreements with the agencies of other states to establish consistent technical review standards, provided that such standards are consistent with state law.
RAPID/Best Practices/NEPA Timelines +=====Agency===== 1. Utilize CUs, CXs and DNAs, which take less time than EAs and EISs. *Finding ways to utilize these types of environmental reviews can lead to reduced timelines. Example: development of new geothermal-specific categorical exclusions, where applicable. *NEPA timeline data are critical to identifying issues and in targeting additional potential for improvement in project timelines. 2. Track timelines to identify applicant/agency delays to increase overall accountability and transparency.<br> 3. Implement BLM policy changes that can help facilitate the goal of lowering the NEPA permitting timelines. *The 2008 PGEIS cleared 78% of geothermal parcels for lease using a DNA, eliminating the need to conduct 295 EAs and effectively reducing the overall project timelines. *A programmatic EIS could be conducted for exploration drilling, or *individual field offices could conduct pre-lease EAs for exploration drilling. =====Developer===== 4. Address the development environment *Actively engage with tribes and the public; and avoid areas containing wildlife protected under the Endangered Species Act (ESA), when possible. 5. Combine environmental analyses for exploration and development drilling. *Use comprehensive POOs or PODs that may only require one EA as opposed to two or more. *While the possibility exists for: **potentially longer up-front analysis, delaying initial exploration efforts and **potentially unnecessary expenditures on analyses for prospective GDPs that are never used due to negative exploration results, *These time and cost expenditures could be more than offset by the time saved in projects that do indicate positive exploration results. 6. Develop EAs and EISs that are more comprehensive than necessary. *Where a project may only require a defined number of drilling permits initially, developers that compile NEPA documents contemplating additional drilling permits (that may or may not be needed) have been able to realize approval for those additional permits by tiering a DNA of the initial EA or EIS. *This practice could also be used for utilization activities, by contemplating more impacts than seemingly necessary in the POU. *At a minimum, the data shows that the median approval time for a tiered DNA was just under 30 days, whereas the median approval time for an EA was 302 days.

RAPID/Best Practices/Public Involvement +''Stakeholder Identification'' – Identifying the appropriate stakeholders can be a challenge. Research should include local government elected officials, departments and agencies, state-level departments officials and representatives, federal agencies, and even individuals or groups within the proponents’ own company. Identify local and national non-profits and non-government groups that may be interested. Identify local landowners and local business owners and organizations (such as local chambers of commerce and economic growth organizations). Local landowner data may be obtained from counties. This data is obtained from tax records and is typically available for purchase. Placing advertisements in newspapers or local circulars that contain project contact information may help to identify and reach those missed by the research methods discussed above. NOAA provides strategies for identifying relevant stakeholders in their report: [http://csc.noaa.gov/digitalcoast/sites/default/files/files/1366314383/participatory_mapping.pdf Stakeholder Engagement Strategies for Participatory Mapping]. ''Identify Issues of Concern'' – It is recommended to research similar transmission projects, and other infrastructure projects in the same area as the proposal. Note the important issues and prepare position statements and responses. Prepare collateral materials to address these topics. One way to identify issues of concern through public involvement is to employ participatory mapping strategies. Participatory mapping is an exercise of working with the public to identify and map publically valued resources and use them as a tool for decision-making. Participatory mapping is used to spatially recognize important issues as determined by the public and can be employed at public workshops and used by the proponent to avoid areas of sensitivity. Participatory mapping is explained in depth in the NOAA report: [http://csc.noaa.gov/digitalcoast/sites/default/files/files/1366314383/participatory_mapping.pdf Stakeholder Engagement Strategies for Participatory Mapping]. ''Establish a multi-channel approach'' – There is no “magic bullet” to identifying and contacting potential stakeholders. Everyone will obtain their news and information using a different method. It is critical to plan and conduct public meetings, create a website for project information and social media accounts (Facebook, Twitter, and YouTube), send press releases to local papers and media, place announcements in local newspapers and radio stations, establish an email list through Mail Chimp or other providers, and send direct mail. It is not recommended to rely on one method to reach potential stakeholders. It is important to establish these channels and the project messaging. The American Association of State Highway and Transportation Officials (AASHTO) Standing Committee on the Environment published the report: [http://onlinepubs.trb.org/onlinepubs/nchrp/docs/NCHRP25-25%2880%29_FR.pdf Potential Use of Social Media in the NEPA Process], discussing the various applications of social media to enhance communications. The report describes how social media should be used to supplement other forms of public outreach and can help to broaden the net cast by proponents to include the internet savvy stakeholder. ''Engage stakeholders early and often, during the planning and routing process'' – Public involvement should begin at a very early stage in the planning process and continue throughout the routing process and through construction. By reaching out to the public at these early stages, the proponent can start fostering relationships with local stakeholders early to establish credibility and gain input before key decisions are made. Local stakeholders can provide unique perspective and intimate knowledge of local geography and land use and potential issues or roadblocks that may not have been considered. The project developer can follow up with key groups based on their interest and anticipated level of involvement, and incorporate outreach to those groups into the public involvement plan. ''Engage the public before applications are submitted'' – It is recommended to engage the public prior to submitting applications and incorporate the input received into project plans to the extent possible, and demonstrate the effort made to involve the public. ''Plan and commit time and resources'' – Plan upfront for public involvement; history illustrates that this investment of time, if not done early in the process, is required later in the project at a higher cost, extended schedule, and often requires that the proponent overcome a lack of credibility. A strong strategy described in a Public Involvement Plan or communications plan will help the team properly implement the campaign. A comprehensive plan should include internal communications, regulatory communications, and public communications. These types of plans are not set in stone and can be refined throughout the course of the project as input is received, new information is collected, or best practices are identified. ''Encourage participation'' – The public can sometimes believe that their input is inconsequential to the decision-making process. Communicate the process of public involvement and the opportunities for them to become involved. Show the public that their comments are being heard, recorded, and being considered in the decision making or planning process as appropriate. This will help to encourage helpful and valuable input. ''Communicate clear and concise messages'' – Make sure that the project message is clear, concise and will resonate with the public. If the project information is confusing or not clearly communicated, it could be taken out of context and stakeholders are less likely to be engaged and provide useful and informed input. Carefully craft the project messaging so that it can be understood by stakeholders with no background in electrical transmission or the energy industry. Include enough detail for the public to understand the process, how alternatives are identified and compared, and the possible impacts related to the project. Include a strong justification of why the project is needed by addressing reliability and electricity supply issues, economics, benefits, and public policy as necessary. ''Form partnerships'' – Reach out to those parties who may be interested in partnering with the project team including local government representatives. Form positive relationships and utilize these stakeholders as a resource for routing and for reaching out to other interested parties. Working closely with affected communities and groups is readily acknowledged as key to greater, faster public acceptance of transmission line routing. Proponents should also partner with the decisional agencies public involvement staff to help define permitting requirements and the project communications plan.
RAPID/Best Practices/Purpose and Need +'''Agency''' * Federal agencies conducting environmental reviews under NEPA will develop a purpose and need statement for the project specific to the NEPA process. The lead agency’s statement specifically identifies the reason for the agency’s involvement in the project and the legal or regulatory responsibilities that the agency must meet, or as typically referred to in the industry, as the NEPA “nexus” or “trigger.” * Cooperating agencies also may provide purpose and need statements in a NEPA document. Like the lead agency’s purpose and need statement, these must address the agency’s specific regulatory authority.
