Proposed Action

ORNI 3, LLC (ORNI 3) is proposing to construct, operate and maintain the Desert Peak 2 Geothermal Project ("Projecf' or "Proposed Action"), a nominal 30.5 MW (rated) geothermal power plant and well field which would be located approximately four miles east of Bradys Hot Springs near Fernley in Churchill County, Nevada (Figure 1 ). The proposed Project area consists of approximately 2,560 acres (4 square miles) in Sections 10, 15, 16, 20, 21, 22 and 28, Township 22 North, Range 27 East (T22N, R27E), Mount Diablo Baseline and Meridian (MDB&M) (Figure 2). Half of this land is private (fee) land (Sections15 and 21) leased to ORNI3's affiliate Western States Geothermal for the development of the underlying geothermal resources. The remainder of the Project area is public land managed by the Bureau of Land Management (BLM) which has also been leased to Western States Geothermal for the development of the underlying geothermal resources. The Proposed Action would include the construction and operation of geothermal fluid production and injection wells, access roads, geothermal fluid pipelines, power generation facilities, possibly a short electrical transmission line, and ancillary facilities. The generated electrical energy would be sold under contract to Nevada Power Company. The total estimated area of new surface disturbance required for the power plant site, transmission line, well pads, pipeline corridors, and access roads would be about 50 acres.

CloseIn order to avoid the potential for violation of the Migratory Bird Treaty Act of 1918, initial ground disturbing activities would not be conducted during the migratory bird nesting season (March to July) unless necessary, and then only after inventories for migratory birds were conducted by a qualified biologist acceptable to the BLM. This survey would identify either breeding adult birds or nest sites within the specific areas to be disturbed. If active nests are present, ONNI 3 would coordinate with the BLM or appropriate state officials, as applicable, to develop appropriate protection measures for these sites, which may include avoidance, onstruction constraints, and/or the establishment of buffers.

CloseORNI 3 and the BLM have agreed to follow specified cultural resource survey and information processing procedures to ensure the protection of cultural resources on both public and private (fee) lands within the Project area (Appendix A). ORNI 3 has agreed that a Class Ill, Phase 1 cultural resource survey, consistent with BLM requirements for such surveys, would be undertaken and completed on all areas of new surface disturbance proposed as part of the Project (on both public and private (fee) lands within the Project area) by a qualified firm under a permit from the BLM. ORNI 3 has also agreed to avoid impacts to any cultural resource sites identified by this survey by adjusting the location of Project feature(s) as necessary to avoid any direct disturbance to any identified cultural resource sites and to avoid any adverse impacts to National Register-listed or National Register-eligible -sites.
Wild Horse and Burro Management
