This statute establishes the animal feeding operation permitting program and gives the Department of Environmental Quality the authority to administer the state permitting program. Permits are required for the construction, expansion, or modification of an animal feeding operation or a livestock waste control facility. Permit applications will be evaluated based on the potential pollutant discharges into waters of the state as well as general facility siting, Additional regulations adopted by the Environmental Quality Council are listed in the Nebraska Administrative Code, Title 130.
