Summary

This legislation designates the Chesapeake Bay, other Atlantic Coastal Bays, and their tributaries and adjacent lands as critical areas of state concern. It is state policy to protect these areas and to prevent the further degradation of water quality. Further development of non-water dependent structures and increase in lot coverage in these areas is presumed to be contrary to the policy of the state, and construction is therefore restricted in these areas. For the purpose of this legislation, "Critical Area" includes all land within 1,000 feet of the Mean High Water Line of tidal waters or the landward edge of tidal wetlands and all waters of and lands under the Chesapeake Bay and its tributaries.
