Kentucky Administrative Regulation Chapter 53, entitled Ambient Air Quality, is promulgated under the authority of the Division of Air Quality within the Energy and Environment Cabinet’s Department for Environmental Protection. Chapter 53 sets the air quality standards for pollutants regulated under the federally mandated Clean Air Act. The purpose of the primary ambient air quality standards is to define levels of air quality that the cabinet judges are necessary, with an adequate margin of safety, to protect the public health. Secondary ambient air quality standards define levels of air quality which the cabinet judges necessary to protect the public welfare from any known or anticipated adverse effects of a pollutant. Chapter 53 implements the federal standard for all air pollutants and requires that Within sixty (60) days of promulgation or revision of any ambient air quality standard by the U.S. EPA, the cabinet shall initiate proceedings to promulgate or review this administrative regulation in conformance with the federal ambient air quality standards.
